1. Introduction
These Terms & Conditions (“Agreement”) constitute a legally binding contract between Protec Technologies Inc. (“PROTEC Recovery,” “we,” “us,” or “our”) and you (“you,” “your,” or “user”) governing your use of the PROTEC Recovery software, recovery devices, subscription services, websites, applications, and related services (collectively, the “Services”).
By accessing, registering for, or using the Services, you confirm that you have read, understood, and agreed to be bound by this Agreement and our Privacy Policy, which is incorporated into this Agreement by reference. If you do not agree to these terms, you must not use the Services.
This Agreement includes provisions that govern automatic renewal of memberships, limitations of liability, disclaimers of warranties, dispute resolution procedures, and your responsibilities when using the Services. Please review this Agreement carefully before proceeding.
Registration and account security
To use the Services, you must create an account and provide accurate, complete, and up-to-date information. You must keep your account details secure and not share your credentials with third parties. Any activity conducted under your account will be deemed as performed by you.
If we detect any unauthorised access, breach of security, or misuse of the Services, we reserve the right to suspend or terminate your account. You must notify us immediately if you believe your account has been compromised.
We are not liable for any loss or damage resulting from your failure to maintain the confidentiality of your account credentials.
3. Eligibility
You must be at least 13 years old (or the applicable age of consent to data sharing in your jurisdiction) to use the Services. If you are under the age of 18, you must have parental or legal guardian consent to enter into this Agreement.
If we determine that you do not meet the eligibility requirements, we reserve the right to suspend or terminate your access to the Services.
Use of Services
We grant you a limited, non-exclusive, revocable, and non-transferable right to access and use the Services for personal, non-commercial purposes only.
You agree that you will not:
Copy, modify, distribute, or sublicense any part of the Services without our written permission.
Use automated systems (e.g., bots, scrapers) to access or collect data from the Services.
Attempt to reverse-engineer, decompile, or tamper with any software or technology related to the Services.
Use the Services for unlawful, abusive, or harmful purposes, including fraud, harassment, or intellectual property infringement.
We may terminate or restrict your access to the Services if we believe, in our sole discretion, that you have violated this Agreement.
4.1 Service Providers and Business Partners
We engage third-party service providers to facilitate payment processing, data storage, analytics, marketing, and customer support. These providers are contractually obligated to process data securely and in compliance with applicable laws.
4.2 Wearable and Health Data Integrations
If you choose to integrate PROTEC Recovery with third-party wearables or health-tracking platforms, we may receive and process your biometric data as outlined in this policy.
4.3 Legal and Compliance Obligations
We may disclose personal data when required by law, regulatory authorities, or to protect the legal rights and security of PROTEC Recovery, our users, or others.
Memberships, Subscriptions and Billing
5.1 Membership and Subscription Plans
PROTEC Recovery offers membership-based access to its recovery devices and software. Memberships may be purchased directly from PROTEC Recovery or through authorised resellers.
By purchasing a subscription-based membership, you agree to pay the applicable fees on a recurring basis (e.g., monthly or annually), subject to automatic renewal unless cancelled in accordance with Section 5.3.
5.2 Wearable and Health Data Integrations
Membership fees are charged automatically to your designated payment method at the beginning of each billing cycle. If payment is unsuccessful, we may suspend or terminate your access to the Services until the outstanding balance is paid.
5.3 Auto-Renewal & Cancellation
Unless you cancel your membership before the next billing cycle, your subscription will automatically renew at the then-current membership rate.
To cancel a membership, you must submit a cancellation request through your account settings or by contacting customer support before the renewal date.
Refunds will not be issued for partial membership periods or unused Services, except as stated in our Refund & Return Policy.
Returns, Refunds and Warranty
Our Refund & Return Policy and Warranty Policy apply to all purchases.
Returns: Users may cancel their membership and return their hardware devices within 30 days of receipt for a full refund, provided the devices are in resellable condition. Return shipping costs are the responsibility of the customer.
Warranty Coverage: All PROTEC Recovery devices, accessories, and apparel are covered by a one-year limited warranty against defects in materials and workmanship. Replacement units will be provided in accordance with our Warranty Policy.

Limitation of Liability
To the fullest extent permitted by law, PROTEC Recovery:
Is not liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or profits, arising from the use or inability to use the Services.
Limits its liability to the total amount paid by you for the Services in the twelve (12) months preceding the event giving rise to the claim.
Disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose, except where legally prohibited.
If local consumer protection laws do not allow these limitations, some exclusions may not apply to you.
Disclaimers and Medical liability
PROTEC Recovery devices and applications are not medical devices and do not provide medical advice, diagnoses, or treatment. The Services are intended solely for recovery tracking and wellness insights and should not be used as a substitute for professional medical care.
We are not responsible for any health-related consequences arising from the use or misuse of the Services. If you have any medical concerns, consult a qualified healthcare provider before using PROTEC Recovery products.
Termination of Services
We reserve the right to suspend, restrict, or terminate your access to the Services at our sole discretion, including but not limited to:
Failure to pay membership fees
Violation of this Agreement
Engagement in fraudulent, abusive, or harmful activities
Termination of the Services does not relieve you of any outstanding payment obligations.
Data Privacy and Security
Our handling of your personal data is governed by our Privacy Policy. By using the Services, you agree to our collection, storage, and processing of your data in compliance with applicable data protection laws.
You acknowledge that while we implement robust security measures, no system is completely secure, and we cannot guarantee absolute protection of your personal information.
governing Law and dispute Resolution
This Agreement is governed by the laws of Northern Ireland. Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of Northern Ireland, except where prohibited by consumer protection laws in your jurisdiction.
You agree to first attempt to resolve any dispute informally by contacting our customer support. If a resolution is not reached, disputes will be resolved through binding arbitration, to the extent permitted by law.
changes to this agreement
We reserve the right to update or modify this Agreement at any time. Changes will be posted on our website, and material updates will be communicated via email or app notifications.
By continuing to use the Services after an update, you agree to the revised Terms & Conditions. If you do not agree, you must discontinue your use of the Services.
